The main cause of a CDL failed drug test is having a sample that tests positive for one of the five categories of drugs. On the alcohol portion, a failed test measures a breath alcohol content of 0.04 or higher. Another way a driver can fail a DOT drug test is by refusing to take one.
The length of time a failed drug screen stays on a record depends on the employer and the type of record. Records from a failed DOT drug test remain in the Drug and Alcohol Clearinghouse Database for five years or until a person resolves the violation through the return-to-duty process and follow-up testing.
A CDL driver who tests positive on a DOT test or refuses to take a DOT test, must successfully complete the return-to-duty (RTD) process with a DOT qualified substance abuse professional (SAP). The requirements for the RTD process are found in 49 CFR Part 40, Subpart O. See 49 CFR 382.501, 382.503.
You will be tested for the following drugs: Marijuana. Cocaine. Opioids (Codeine, morphine, heroin, hydrocodone, hydromorphone, oxycodone, oxymorphone) Phencyclidine (PCP) Amphetamines, Methamphetamines, and Methylenedioxymethamphetamine (MDMA)
Failed DOT drug testing means automatic removal from these functions. That said, failing the test does not mean losing your CDL license. However, your employer will suspend you from many of your duties depending on the company policy. Employers may also fire employees for failing the test.
Subpart IProblems in Drug Tests (a) As the employer, if the MRO informs you that a positive drug test was dilute, you simply treat the test as a verified positive test. You must not direct the employee to take another test based on the fact that the specimen was dilute.
In general, no. Convictions for drug-related charges may show up on a criminal background check, but the results of employment drug screenings generally will not appear on a criminal background check.
