Evicting a tenant in North Carolina can take around one to three months, depending on the reason for the eviction and whether the case is held in district or small claims court. If tenants file an appeal, the process may take longer.
North Carolina landlords must give tenants at least ten days in which to pay the rent or move. If the tenant does neither, the landlord can file for eviction.
Tenants can only be evicted by the Sheriffs Office, and only after the Court has entered a judgment against them and the Clerk issues a Writ of Possession. Normally, the eviction process takes about 3 weeks.
The tenant will be provided with a period of ten (10) days to file for an appeal at the court. If the tenant has not made an appeal, he is given seven (7) days from the filing of a Writ of Possession to move out and clear his belongings from the premises.
For month-to-month leases, there must be seven days of notice. For year-to-year leases or those with other definite terms, landlords must notify the tenant, or vice versa, within a month of the end of the lease. On leases lasting between one week and one month, notice must be given at least two days in advance.
If court decides that you should be evicted, a red tag will be posted on your door. It will tell you how long you have to leave the property. In general, that time will be five days. After that, your landlord can ask that the sheriff come to your home and set out your things.
North Carolina laws dictate that a tenant must vacate the property within 5 days once the Writ of Possession is posted or delivered to the sheriffs office. This, along with the 10 days before the Writ is issued allows the tenant a maximum of 15 days to appeal the ruling and vacate the property.
If you lose the case after getting a continuance, you will probably get no more than 3 days to move. What happens if I dont show up in court? You will lose. The landlord will get an eviction order.
