USCIS increased the maximum validity period to five years for initial and renewal Employment Authorization Documents (EADs) issued to the following categories of noncitizens: Refugees (A03); Noncitizens paroled as refugees (A04) (up to 5 years not to exceed length of parole);
Filers wishing to renew an existing employment authorization card (EAD), should file Form I-765 within 6 months of the expiration date on their current EAD. We recommend you do not file a request to renew your EAD more than 180 days before the expiration of your EAD.
Form I-765 Processing Times In general, it takes about 6.7 months for U.S. Citizenship and Immigration Services (USCIS) to process Form I-765. Previously, USCIS processed work permit applications within 6.7 months, but a growing backlog has caused additional delays.
If your work permit has expired, or if it will expire within the next 6 months, you can renew it by simply filing a new Form I-765. You will also need to pay a filing fee (as with the original application), unless youve applied for a fee waiver and have received approval.
A case denial means that USCIS has reviewed your application and determined that youre not eligible to receive a work permit. If you receive a denial, you may need legal help to appeal your case or find another pathway to an EAD.
Therefore, you may present Form I-797C with your facially expired EAD to an employer to demonstrate that you are eligible for the up to 540-day automatic extension.
On April 8, 2024, the Department of Homeland Security published a temporary final rule (89 FR 24628) that temporarily increases the automatic extension period of employment authorization and/or Employment Authorization Document (Form I-766 or EAD) validity from up to 180 days to up to 540 days from the expiration date
Form I-765 is the physical document. Form I-766 is an EAD card, which you can keep in your wallet. Both Form I-766 and I-765 are valid EADs. You actually use Form I-765 to apply for your Form 1-766 card.
