Leaves of absence may be formal or informal; and may be initiated by either the claimant or the employer. The unemployment insurance claim may be filed either during the leave or after the leave has ended, sometimes with differing results.
A: You are not entitled to unemployment benefits while on FMLA. The reason being, that you are not unemployed - you are still attached with your employer.
Duration. You can request leave without pay for personal needs for either up to 3 months or for more than 3 months but up to one year.
A blackout period is a period during which a business prevents its employees from taking annual leave. These periods usually coincide with major holidays when businesses are busiest. As a result, businesses may want to implement a blackout period to ensure they have adequate staff.
If the reason for voluntarily taking a period of leave is without just cause, you will not be paid regular benefits for the entire period of the leave. However, you may still be paid maternity, parental, sickness and compassionate care benefits as long as you qualify for these benefits.
Unfortunately, you are generally not able to collect unemployment while on FMLA leave. There are a couple of exceptions: You have restrictions but believe that you can work, and your company forces you to take leave anyway. You can work in other positions at the company, but your employer wont let you.
Yet another common misconception when it comes to employment law: You cannot dismiss an employee on leave (sick, pregnancy and parental or other), or shortly after he returns to work. The reality is that it is unlawful to dismiss an employee because he is going to take, is taking, or has taken a leave.
You can receive EI from 14 weeks up to a maximum of 45 weeks, depending on the unemployment rate in your region at the time of filing your claim and the amount of insurable hours youve accumulated in the last 52 weeks or since your last claim, whichever is shorter.
