A Trust Deed is a legally binding agreement, so cannot be cancelled at will. If you are unable to make payments which your creditors find acceptable, your Trust Deed may fail. The failure of a Trust Deed is likely to end in your sequestration.
You will usually be discharged after four years, but some trust deeds can last for longer. This information will be included in the terms of the trust deed. If the trust deed does not become protected, your discharge will only be binding on those creditors who agreed to the arrangement.
Trust deed investing has certain risks and disadvantages. Unlike stocks, real estate investments are not liquid, meaning investors cannot retrieve their money on demand. Also, investors can expect only the interest the loan generates; any additional capital appreciation is unlikely.
You may wish to talk to your trust deed firm about this to judge their thoughts. A short break may be viable in the circumstances, with the missed payments made up later. They may also suggest paying every four weeks rather than calendar monthly. Its really up to your trustee though.
You have up until 5 days before the foreclosure sale to stop the process. This is called reinstatement of the loan.
If you stop making payments towards your trust deed, without agreement from your trustee, they can: apply for an Earnings Arrestment Order to take the payments directly from your wages. ask the court to make you bankrupt. refuse to discharge you from the trust deed, which will stop your debt being written off.
