The faint hope clause is no longer available for any offences committed after December 2, 2011. Persons convicted of multiple murders that occurred after January 9, 1997 are ineligible to apply for a reduction in their parole eligibility period.
An amendment to the Criminal Code passed in 2014 granted courts the authority to issue consecutive life sentences, in effect allowing for multiple periods of parole ineligibility to be stacked and lead to a total parole ineligibility period of greater than 25 years.
The Faint Hope Clause offers an inmate serving a life sentence for murder or high treason, the possibility to apply to have his/her parole inadmissibility date reviewed, after serving at least 15 years.
A life imprisonment sentence refers to a term of imprisonment that in Canada, lasts for the offenders life, a period of 25 years, with exceptions for parole eligibility and/or statutory release.
In analyzing the data of offenders who have been released on parole, those who were released early due to faint hope had similar rates of recidivism for technical violations but slightly lower recidivism rates for new offences.
