Evictions are not listed on credit reports. However, if you still owe back rent, your former landlord may have sold the debt to a collection agency, and a collection is a derogatory mark that will appear on your report.
Florida tenant screening should include eviction records when screening an applicant for a lease or rental agreement. Eviction records can be searched either statewide or nationwide.
The short answer is: Theres no such thing as an Eviction Expungement in North Carolina. Expungement has a very specific definition in the legal world tied to criminal records. Evictions are purely civil matters (usually) and therefore not eligible for what we understand to be a traditional expungement.
Generally, an eviction report will remain part of your rental history for seven years. If you are in the process of applying for a lease, ask the landlord or leasing company to tell you the name of the tenant screening company they use.
Tenants can only be evicted by the Sheriffs Office, and only after the Court has entered a judgment against them and the Clerk issues a Writ of Possession. Normally, the eviction process takes about 3 weeks.
California passed a law in 1992 disallowing certain eviction case information from being included in credit reports. However that law was quickly deemed to be unconstitutional since eviction cases are considered a matter of public record.
Once the lawsuit is filed, the eviction will be permanently in the public record, and could be used against you in the future by prospective landlords if you dont get an Order of Limited Dissemination.
Will evictions show up on my record? Evictions are not criminal and will not show up in a criminal record. However, evictions are public record, which may appear in credit reports or affect the tenants ability to qualify for another lease.
