If you want to expunge a conviction, the offense that you were convicted of cannot be any of the following: A violent crime; A sex crime; Distribution of controlled dangerous substances; Misdemeanor domestic abuse battery; Misdemeanor stalking; or. A crime against a minor.
For most misdemeanors, you need to wait two years after you have completed any sentence, probation or parole before applying for expungement. If the misdemeanor involved controlled substances, you may need to wait five years.
The expungement order shall direct that there be expunged from all official records, except the nonpublic records referred to in subsection (b), all references to his arrest for the offense, the institution of criminal proceedings against him, and the results thereof.
Expungement Processing Fee: The processing fee for an expungement is $550. The $550 fee must be paid in Room 104 at the time of the filing of the motion for expungement.
How long does my arrest or conviction stay on my Louisiana criminal record? Forever, unless you have it expunged. There are, however, limits on how old convictions can be used against you by the authorities and private companies.
Subsequently, the requestor must file the petition, including all required documents and forms, with the court clerk. As well as get a copy of the criminal record from the State of Louisiana within 30 days of filing the petition. Also, they must pay the required expungement fee of $550.
Remember, while many felonies might be eligible, certain serious crimes, like murder, sexual battery, and child abuse, cannot be expunged.
