hello my name is Matthew guto and Iamp;#39;m a criminal defense attor at the law firm of guto and Arno and LLP here in New York City you may have heard the good news that the New York State Legislature recently passed a law which will take effect in October of 2017 that is going to give certain individuals an opportunity to seek sealing or expungement of their criminal convictions here in New York state now the law is going to set for some very specific rules about who will be and who will not be eligible to seek sealing or expungement of their criminal background first and foremost this law is only going to apply to convictions under New York state law so if youamp;#39;re living in New York but your criminal records from another state then this law is not going to apply to you or provide you with any relief if youamp;#39;re convicted of a felony offense then this law also will not be of any use to you furthermore if your criminal record is too large you will be to ineligible to see

A first offense DUI charge that resulted in a conviction will remain on your record for at least five years. In order to have the DUI conviction removed from your criminal record, you will need to file a Motion to Expunge with the Court where your case was heard.
In September of 2017, expungement eligibility for misdemeanors was expanded to include individuals with between 2 and 6 convictions, who may petition to expunge those convictions after 10 arrest-free years.
If you have a misdemeanor on your record, you must wait five years after your sentence has expired to be eligible to have the offense removed from your record. For example, if you received a three-year probation period as a sentence for your misdemeanor, you must wait a total of eight years to be eligible.
Expungement Process: What to Expect Expansions under the Clean Slate laws include eligibility for up to three felonies and unlimited misdemeanors, excluding certain assault or weapons offenses and felonies that carry a maximum sentence of life in prison.
First offenders may petition for expungement of the record of conviction after 10 arrest-free years (for felonies) or 5 arrest-free years (for misdemeanors). R.I. Gen. Laws 12-1.3-3(b).
Only certain criminal arrests or convictions, including some misdemeanor crimes and certain non-violent felonies, may be eligible for expungement. Eligibility is dependent on a variety of factors.
Rhode Island Law allows for liberal expungement of DUI arrests and convictions. With some exceptions, most individuals charged and convicted with first offense driving under the influence in Rhode Island can, at some point in the future, expunge the record of that case.
Remember, while many felonies might be eligible, certain serious crimes, like murder, sexual battery, and child abuse, cannot be expunged.
