To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Florida is specific about which felonies can and cannot be expunged. Heres a breakdown: Third-degree felonies: Many third-degree felonies are eligible for expungement, but not all. Common ones include grand theft (3rd degree), possession of controlled substances, and certain types of fraud.
Under the Clean Slate Act, New Yorkers will be eligible to have conviction records automatically sealed 3 years from sentencing for misdemeanors and 8 years from sentencing for felonies, not including time incarcerated.
Waiting Period: (ii) 8 years for a (non-A) felony. (ii) if there was no sentence of incarceration, from the sentencing date. Note: If the individual is convicted again during the waiting period, the waiting period is reset to the most recent conviction.
You are applying to seal an ineligible offense, including a violent felony, Class A felony, homicide felony, sex offense, sexual performance by a child offense, or a felonious attempt or conspiracy to commit any of these ineligible offenses.
Most attorneys charge $2,000 to $5,000 for these services, and they often take more than a year to complete. The best way to see what you are eligible for is to take our free online eligibility test. Only in very limited circumstances does the state of New York provide for expungement of someones criminal record.
In order to be eligible for expungement, you must have satisfied your sentence including any supervision. Certain misdemeanor convictions may be filed after five (5) years. Certain felony convictions, assault in the second degree and common law battery convictions may be filed after seven (7) years.
You can ask the court to seal certain felony and misdemeanor convictions: If you have no more than 2 misdemeanors or no more than 1 felony and 1 misdemeanor conviction and have been crime-free for 10 years. Visit Sealed Records: After 10 years. If you have successfully completed a drug treatment program.
