Pennsylvanias Accelerated Rehabilitation Disposition (ARD) is a court program typically offered to first-time offenders who are unlikely to drive under the influence of alcohol again. After completing an ARD program, a person may be eligible to have his or her DUI record erased, after 10 years.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Pennsylvania has a 10-year lookback period for prior DUI convictions, meaning that if youre arrested for driving under the influence within 10 years of a prior DUI conviction, you can receive harsher consequences than you would for a first-time driving under the influence conviction.
What kinds of charges are eligible for expungement in PA? All criminal charges that did not result in a conviction are eligible for expungement in Pennsylvania. For example, charges that are not guilty, withdrawn, dismissed, or nolle prossed are eligible for expungement.
A DUI can be a summary offense (and therefore can be an expunged DUI) if it falls under General Impairment (. 08 percent to . 099 percent blood alcohol concentration) and is a first offense. Some DUI offenders are ineligible to apply for Pennsylvanias ARD program.
In Pennsylvania, a DUI conviction will remain on your record for life unless it is expunged or given limited access relief. Because your conviction is a matter of public record, it will be reflected in your criminal background and credit records as well as your insurance and drivers license history.
Pennsylvania has expungement laws that help people who received a summary offense, Accelerated Rehabilitative Disposition (ARD) or had an arrest that did not lead to a conviction.
