Inability to Enforce Rights: An expired trademark typically means the owner loses the ability to enforce their trademark rights against others using a confusingly similar mark. This situation allows other businesses to use the same or similar mark without facing trademark infringement claims.
If you want to challenge a registration due to nonuse in an attempt to get the registration canceled, you can request an expungement or reexamination proceeding. These processes may be less expensive and quicker than a contested cancellation proceeding before the Trademark Trial and Appeal Board (TTAB).
Should an application fall into an abandoned status at any time during the registration process, a petition fee of $150 is required to revive and resume prosecution of the application.
If your trademark has fallen into dead or abandoned status unintentionally, you may petition the USPTO within 60 days of the Notice of Abandonment. After the 60 days have lapsed, or if you cannot document the abandonment was unintentional, you will need to file a trademark application with the USPTO.
To claim the dead trademark you will need to complete an application with the USPTO. Provide your name and address, the name of the dead mark, a statement as to the goods and services that you wish to sell under the mark and a statement as to whether you have attempted to register the mark previously.
A canceled trademark is a trademark that, for one reason or another, has been deemed invalid. When a trademarks registration has been terminated, that means it can be registered by another person or business. It also means the trademark cannot be used in any way to deny the registration of a similar trademark.
Expungement Proceedings. The new ex parte expungement proceeding is codified at 15 U.S.C. 1066a and provides a basis for cancellation of a trademark registration when the mark was never used in United States commerce for some or all of the goods and/or services listed in the registration.
The petition should clearly state the grounds for cancellation, provide supporting evidence, and explain why you believe the trademark registration should be canceled. File the Petition: Submit the cancellation petition to the appropriate trademark office or administrative body.
