Yes. However, the sealing of criminal violations of restraining orders is subject to a special provision in the law that is specific to both 209A abuse prevention orders and 258E harassment prevention orders.
What fees do I pay for an expungement? You must pay a $250.00 administrative fee to the Solicitors office, a $25.00 fee to the South Carolina Law Enforcement Division (SLED), and $35.00 filing fee to the Clerk of Court. You pay the fees with separate money orders when you apply to your Solicitors office.
First offense simple possession of any drug can now be expunged after three years; First offense possession of prescription drugs can be expunged after three years; and. First offense possession with intent to distribute (PWID) and drug can be expunged, however not until 20 years after completion of the sentence.
Expungement shields a criminal conviction from public view during a criminal background check. Once your criminal record has been expunged, you can truthfully answer, in all but a few circumstances, that you do not have a criminal record.
Both sealing and expunging criminal records allow you the opportunity to deny the arrest ever occurred. In both instances, these records are no longer available to the public. Expunged records are physically destroyed. Sealed records are hidden from public view.
Misdemeanor Offenses: Convictions for misdemeanors that carry a maximum sentence of 30 days and/or $1000 fine may be eligible for an expungement. You must wait three years and have no other convictions in those three years before applying for the expungement/five years if the conviction is for Domestic Violence.
How long does the expungement process take? The process may take up to six (6) months from the date the Expungement Office receives the completed Expungement Application. You will NOT receive a confirmation of receipt of your Expungement Application.
