Should you disclose expunged records during the Global Entry application process? In general, the answer to this question will almost always be an emphatic: yes, you should disclose the record even though it has been expunged.
On the other hand, if your record is expunged, it is forgotten for most purposes and likely sealed from public view. Receiving a pardon frees you from the conditions of your sentence and restores your civil rights (such as the right to vote or sit on a jury). But it does not clear your record.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Reasons for Ineligibility You may not be eligible for participation in the Global Entry program if you: Provide false or incomplete information on the application; Have been convicted of any criminal offense or have pending criminal charges or outstanding warrants (to include driving under the influence);
Pardons remove or decrease penalties. Expungement clears a charge from a criminal record. Pardons may cover any charge. Expungement only covers certain types of misdemeanors.
You May Be Able to Seal Your DC Criminal Record If: The crime on your record has since been legalized or decriminalized, like possession of small amounts of marijuana. The conviction on your record is misdemeanor and at least 8 years have passed since your last interaction with the criminal legal system on the case.
A pardon does not, however, erase the fact that an individual was convicted of a crime. The criminal record is not erased, but it is kept separate and apart from other (non-pardoned) criminal records.
A pardon does not seal a persons criminal record, and it is not an expungement, which is the removal of a crime from a persons record. A person who has been pardoned must still indicate, when asked, that they were convicted of a crime.
In short, regardless of what your attorney advised you with respect to the effect of an expungement, the bottom line is that TSA has and will continue to deny Global Entry applicants for failing to disclose expunged records.
A pardon is an expression of forgiveness and can help eliminate some of the consequences of a conviction. If you have previously applied for pardon and have received a notice that your application was denied, there is no waiting period to reapply.
