A stet is a Latin term meaning let it stand and is used in Maryland criminal cases. Its an indefinite postponement of prosecution where the charges remain on file but are inactive. A stet is not a conviction, guilty plea, acquittal or dismissal. The case is simply placed on an inactive docket.
Offenses that could not be expunged or set-aside included offenses like murder, criminal sexual conduct or any traffic offense.
Stet is a Latin word that means to stand still. Its usually used in legal contexts to indicate that a judge will not change a court order. The stet docket is a dormant docket, and if your case is sent to it, you are effectively dismissed from that point forward.
Its important to understand that a stet is not a conviction. Its an indefinite postponement of a criminal case for up to 3 years. A stet can be expunged after three years if (1) the case is not reopened and (2) the defendant is not convicted of a crime during that time period.
The filing fee is $30 for eligible guilty dispositions and is nonrefundable, even if denied. The fee is for each case (not for each charge related within a unit of the case). If you cannot afford the fee, you may request that the court waive the filing fee.
You may file three (3) years after the case was marked stet on the docket. However, if it is less than three (3) years you may file a motion for a good cause exception and the court will decide whether there is good cause to grant an early expungement.
(1) ELIGIBILITY. A person is eligible to petition a court to expunge a criminal history record if: (a) An indictment, information, or other charging document was not filed or issued in the case giving rise to the criminal history record.
Most common expungable convictions: 5 Year. Public intoxication. Possession/administration of CDS. Drug Paraphernalia. 7 Year. 2nd Degree Assault. CDS with Intent to Distribute. 3rd Degree Burglary. 10 Year. Felony theft. Burglary 1st and 2nd Degree. Attempt, conspiracy, or solicitation of any of these listed offenses.
