In Illinois, certain misdemeanor and felony drug convictions can be expunged. For example, first-time minor drug possession offenses may be eligible for expungement. Illinois Felony Expungement allows some non-violent felony records, like certain drug offenses, to be cleared.
Crimes that cannot be expunged in Pennsylvania include violent crimes and sexual offenses, among others. When the courts expunge a conviction or charge, the court is removing it from the record or sealing the record from the public.
When a person wishes to expunge their summary offense, the following must apply to their situation: At least 5 years have passed since their conviction. The defendant has completed their assigned sentencing. In addition to the repayment of fines, all associated court costs have been paid.
In order to expunge summary offenses, a person must petition the court. Nonetheless, certain information related to the crime may still exist within other records. Private background searches may also reveal evidence of minor criminal offenses even if they have been expunged in public records.
Pennsylvania law allows for the expungement of summary offenses IF the person has been free of arrest or prosecution for five years following the conviction for that offense. Basically, if a person has stayed out of trouble for five years, he or she is eligible to have a summary conviction expunged.
Minor federal drug offenses can be expunged under 18 U.S.C. 3607(c). If a person is found guilty of an offense under section 404 of the Controlled Substances Act (21 U.S.C. 844) or an offense described in that section, he may be able to have his record expunged.
