You are applying to seal an ineligible offense, including a violent felony, Class A felony, homicide felony, sex offense, sexual performance by a child offense, or a felonious attempt or conspiracy to commit any of these ineligible offenses.
Massachusetts allows expungement in two circumstances: For felonies older than seven years, or misdemeanors older than three years, expungement may be available if: You have no more than 2 (two) separate criminal cases on your record. Multiple offenses arising out of the same incident are a single offense.
Under Marylands expungement law, the unit rule states that only cases can be expunged, not charges. In other words, a person cannot expunge individual charges from a case, even if they were not found guilty, when that same case includes an ineligible charge.
The Clean Slate Act (CPL 160.57) will automatically seal an individuals New York State criminal records. The law takes effect on November 16, 2024.
If the offense is a felony, you must have completed all parts of your sentence at least 7 years ago. If the offense is a misdemeanor, you must have completed all parts of your sentence at least 3 years ago.
In 2018, Massachusetts passed legislation that created an opportunity to expunge juvenile and adult criminal records for folks whose offense was charged prior to their 21st birthday.
The main difference is ACCESS. Sealing limits access to records vs. Expungement which is the destruction of the records.
This Clean Slate bill requires the Commissioner of Probation to automatically seal criminal and juvenile records after the applicable waiting periods without the filing of a petition.
