As of 2021, Georgias Second Chance Act enables you to restrict and seal the records of most types of misdemeanor convictions, as long as four years have passed since you completed your sentence, and you have not gotten any new convictions during that time.
Q: How long does a misdemeanor conviction stay on your record in Georgia? A misdemeanor will stay on your criminal record for life in Georgia unless you have it deleted. To qualify for expungement, you must have completed your sentence and not have any other convictions.
Driving records arent exactly something that can be expunged. After a number of years certain things will drop off (typically 7 years for most offenses, points every 2 years). But there is no expungement process in Georgia for ones driving record.
If your arrest was after July 1, 2013, you will need to contact the prosecutor in your case to inform you about expunging your record. The prosecutor will provide you with a form and direct you thereafter. This form may cost as much as $50.
No, records restricted following state laws (O. C. G. A. 35337) do not show up in background checks. However, records under time-expired restrictions may be provided to the Federal Bureau of Investigation (F. B. I.) or other states for non-criminal justice uses.
Most misdemeanor convictions are eligible for expungement, but an individual can seek expungement for a maximum of two separate misdemeanor convictions. Serious Felony convictions such as armed robbery and aggravated stalking are not eligible for expungement.
