A petition for expungement or seal can be filed with a local court of jurisdiction in Indiana by an individual (pro se) or by private legal counsel.
A recent change to Indianas expungement law eliminates the need for persons arrested or charged with a criminal offense to petition to have their records expunged where there has been no conviction.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Thus, most misdemeanor and felony convictions are eligible for expungement under the new law. However, not everyone qualifies for an expungement. The first step to determining if you qualify for expungement is to check your criminal record. There is no limit to the number of misdemeanor offenses that can be expunged.
Indianas Second Chance Law was passed in 2011 and took effect in July 2013. Under this law, individuals with criminal records are allowed to request that public access to their criminal histories be restricted through expungement.
Offenses that could not be expunged or set-aside included offenses like murder, criminal sexual conduct or any traffic offense.
The petition to expunge arrest records should be filed in the court where charges were filed or, if no criminal charges were filed, in a court in the county where the arrest occurred. I.C. 35-38-9-1(e). There is no filing fee required for a petition under this section.
In Indiana, the average cost of expunging a criminal record ranges anywhere from $250 to $1,000 or more. This fee covers the cost of filing petition papers, obtaining court orders and other necessary paperwork fees.
