Records contained within an individuals criminal history file may be expunged or sealed under Indiana law. A petition for expungement or seal can be filed with a local court of jurisdiction in Indiana by an individual (pro se) or by private legal counsel.
Indianas Second Chance Law was passed in 2011 and took effect in July 2013. Under this law, individuals with criminal records are allowed to request that public access to their criminal histories be restricted through expungement.
The Difference Between Sealing and Expunging Criminal Records. In Indiana, expunged records are not destroyed or erased, as seen in other parts of the United States. Following IC 35389, if a court grants the request to expunge a criminal case file, the criminal record is sealed.
Do I have to pay to seal my criminal record? If you apply through the Minnesota Attorney Generals Office and you qualify for expungement you do not have to pay the $300 filing fee to the Court.
