Crimes That Can Make You Inadmissible to Canada DUI (including DWI, DWAI, reckless driving, etc.) theft. drug trafficking. drug possession. weapons violations. assault. probation violations. domestic violence.
Yes, someone with a criminal record can visit or move to Canada, but there are restrictions. If you have a criminal record and want to visit Canada, you may need to apply for a Temporary Resident Permit (TRP). A TRP allows people who are otherwise inadmissible to enter Canada for a temporary period of time.
Criminal records stay with you for life. They do not automatically disappear, not after several years and not for minor offences. Except in a few cases, you may apply for a record suspension (pardon) if you want the RCMP to keep your record separate from other criminal records so that the information is not accessible.
If an application for expungement is approved, federal records of that conviction will be destroyed or removed. Unlike a record suspension/pardon, expungement is also available to those both living and deceased.
If you received a Canadian record suspension or pardon (as it was formerly called), you are no longer inadmissible because of that conviction and can likely enter Canada. If you received a pardon or discharge from another country, check with the IRCC office closest to you for more information.
Persons convicted of offence(s) listed in the Schedule to the Expungement Act are eligible to submit an application to the PBC to have the record(s) of their conviction(s) expunged. If the person is deceased, an appropriate representative, such as a family member or a trustee, can apply on their behalf.
Even if the expungement equates to no conviction in Canada, it is important for Americans entering Canada with an expunged DUI to have proof that it was successfully abolished as border agents might require evidence of the final result.
In some states, an expunged criminal record could equate to a non-conviction in Canada. Not all expungements are treated this way by Canadian authorities, however, so speaking to a Canadian lawyer about your unique situation is always advisable.
