1. CONSENT TO SUBLEASE. The Landlord hereby consents to the Tenants sublease of the Lease to the New Tenant on the terms of the sublease of the Lease, a copy of which is attached as Exhibit B (the Sublease).
A sublease is a process of renting out a property to a third party by a tenant for a time period of the lease contract of the existing tenant. Lease contracts are contracts between a tenant and the owner of the property.
Generally speaking, a sublease agreement is a legally binding contract, and both parties are expected to uphold their respective parts of the agreement. However, there are certain circumstances in which a tenant may be able to break the sublease early.
Your request letter should contain all the basics your reason for wanting to sublet, the start and end dates of the sublease, the name of your proposed tenant and their current address, contact information for your time away and your roommate approval form.
How to write a sublease contract Provide a description of the property. Add the names of the tenant and subtenant. Lay out the terms. Discuss any additional information. Decide the amount of rent. Determine the security deposit amount. State any late fees. List the policies and/or conditions.
State the rent schedule and amount. State the agreed upon rental amount and when the subtenant must pay it. In the sublease of property, the subtenant usually pays monthly. For example, Subtenant will pay Tenant the sum of $500 monthly, to be received by the Tenant by the 3rd day of each month.
Lessee Tenant shall not assign this Lease or sublet any portion of the Premises Real Property without prior written consent of the Lessor, which shall not be unreasonably withheld. Any such assignment or subletting without consent shall be void and, at the option of the Lessor, may terminate this Lease.
If your tenant sublet the rental unit and the subtenant has remained in the rental unit after the date the subtenancy ended, you may apply to evict the subtenant. You must make the application no later than 60 days after the date the subtenancy ended.
