Although this is the most basic requirement, there are many other restrictions and exceptions. Because of this, the Public Defender cannot tell you right away if you are eligible for an expungement. From start to finish, the expungement process usually takes 6-8 months.
Can anyone see my sealed/expunged criminal record? Most employers, landlords, etc., are not allowed access to expunged records. But under limited circumstance, there are some exceptions for police; clerk of courts; or Ohio Bureau of Identification and Investigation, and certain state licensing agencies.
Expungement of Felony convictions, suspended sentences, jail sentences or probation. A felony with the following sentences: probation, suspended sentence or jail can be expunged ten years after the completion of the sentence or probationary period.
Make sure you have made at least three copies of everything. Take the three copies along with your original Application for Sealing of a Criminal Record and the $50 fee to the Clerk of Courts in the county which you were tried and convicted. File the documents with the clerk.
It usually costs $50 to file a motion to expunge a conviction record. The cost may be higher in some courts. However, if you are a low-income person, you may file with a poverty affidavit and pay the costs later. Filing an application to seal a not guilty, nolled, or dismissed record is FREE.
If the person is asked about a case for which the records were sealed, the person may respond as if the case did not occur (with limited exceptions). Although a lawyer is not required for the record sealing/expungement process, you may feel like you would benefit from representation.
Who Can See Sealed Criminal Records in Rhode Island? The person whose record was expunged or sealed. Bar admission committees. The sentencing court, if the case party is convicted of a different crime. Disciplinary committees or boards. Law enforcement agencies. The Commissioner of elementary and secondary education.
In most cases, sealed/expunged records will not appear on background checks. This means it may be easier for you to apply for a job, professional license, get housing, apply to college or apply for credit. But there are exceptions when sealed records may be accessed by some employers or agencies.
