(1) ELIGIBILITY. A person is eligible to petition a court to expunge a criminal history record if: (a) An indictment, information, or other charging document was not filed or issued in the case giving rise to the criminal history record.
Criminal records begin the moment a person is arrested for a crime. They effectively last for the rest of your life.
In the state of Florida, you typically can only have your case sealed and expunged once in a lifetime. Under Section 943.059, Section 943.0585, or previous versions of those statutes, in Florida. With respect to the relief offered by these statutes, a person may only seal or expunge one arrest record in one proceeding.
Florida law permits the sealing or expunging of only one criminal history in a lifetime.
Expunging/sealing an arrest record on grounds of actual innocence. Sealing an arrest record in the interests of justice. Sealing a conviction for an eligible misdemeanor Expunging a criminal record for ID. Expunging a juvenile record. Setting aside a conviction under the Youth Rehabilitation Act.
Misdemeanors: 3 years (5 years for DV cases) Class C Felonies: 5 years. Class B Felonies: 10 years. Class A Felonies: Can NOT be expunged.
With respect to the relief offered by these statutes, a person may only seal or expunge one arrest record in one proceeding. More than one arrest record may be sealed or expunged in a single proceeding if the court, in its sole discretion, finds the arrests in question to be directly related. 8.
Usually, this designation will appear as illicit activity identified, which could lead others to believe you have a criminal record. After the case is resolved (either charge are dropped, a conviction is made, or you successfully defend yourself), the police will remove or update the designation ingly.
