Expunged records do not have to be disclosed to an employer even after they make a conditional offer of employment. If you cannot expunge your record, you may be able to get relief through a Certificate of Rehabilitation, governors pardon, or sentence commutation.
A judge will only show the expunged record to law enforcement if the defendant is under investigation in a new criminal case. The only times when a judge will make the expunged record visible on a pre-employment background check is if the defendant is applying for a position in an education or law enforcement career.
Criminal records that have been expunged will generally not show up a background check. People with expunged records usually do not have to disclose them when asked. This can be helpful to people seeking to gain employment.
Expunged Records and background Checks should not appear. However, the arrest and court case (without the conviction) might still appear. Exceptions: Certain types of employment, like government jobs or positions that require state licensing, might still have access to or be informed about expunged convictions.
The easiest way to check if your criminal record has been expunged is to visit the court where your case was handled and ask to see the records. If the court tells you they dont have your records, it means they were expunged.
