hi everyone attorney eric ramos here today im going to answer the question what happens if my expungement is denied so if an expungement is denied that usually means that there was something wrong at the beginning something wrong on the part of the person who filed the expungement or wrote up the paperwork or maybe you just werent eligible in the first place so by law when youre eligible for expungement the law states that court must grant the expungement or expunction so if they dont rent it then theres probably something wrong with the application maybe it didnt meet certain technical requirements sometimes when an application or a petition is filed for expunction the actual state prosecutor the assistant district attorney may may find something wrong with it and object to it so it could be something as simple as it wasnt properly docHubd it didnt contain certain information like your drivers license your date of birth your social security number certain information thats

You may be able to restrict access to a portion of your criminal record under the Second Chance Law. In 2011, the Indiana General Assembly passed legislation permitting individuals to seal portions of their criminal record.
In Indiana, the average cost of expunging a criminal record ranges anywhere from $250 to $1,000 or more. This fee covers the cost of filing petition papers, obtaining court orders and other necessary paperwork fees.
Why might I not be able to expunge or seal my record? An offense under any of the following Texas Penal Code Sections: 19.02 (murder) 19.03 (capital murder) 20A.02 (trafficking of persons) 20A.03 (continuous trafficking of persons) 22.04 (injury to a child, elderly individual, or disabled individual)
Indiana Code chapter 35-38-9 lists the criminal records that are eligible for expungement. These include arrest records, misdemeanor convictions, Class D or Level 6 felonies, and certain higher level felonies.
Some felonies can be expunged. However, some crimes are ineligible for expungement, including sex crimes, violent crimes, crimes resulting in bodily injury to another person, homicide, and human trafficking. For most felonies, an individual must wait eight years after conviction to request an expungement.
Indiana Code 35-38-9-1 requires the Court to expunge the record automatically. One caveat is that since this is a new law, some Courts may not be in the habit of doing this or may not do it automatically.
