Violent misdemeanors such as child abuse and assault with a deadly weapon are not eligible. Class A felonies, including murder, and felonies requiring sex offender registration, such as sexual battery, incest, and human trafficking, are never eligible for expunction.
Contrary to popular belief, a criminal record is not automatically sealed, expunged, nor does it disappear after a number of years. In fact, a felony will stay on ones record until an application for expungement is filed with the Court to expunge and/or seal a record.
Rape, sexual batter, corrupting a minor, gross sexual imposition, sexual imposition, obscenity involving a minor, ography involving a minor, illegal use of a minor in ography, and felonious sexual penetration are all convictions that cannot be expunged.
UPDATE TO EXPUNGEMENT LAWS EFFECTIVE 2022: A new bill in Tennessee that will take effect on July 1, 2022, permits an individual to apply to have a conviction expunged even they have been convicted of one or more other criminal offenses than the conviction they are currently seeking to expunge.
Some felonies can be expunged. However, some crimes are ineligible for expungement, including sex crimes, violent crimes, crimes resulting in bodily injury to another person, homicide, and human trafficking. For most felonies, an individual must wait eight years after conviction to request an expungement.
Expungement means that the record is completely destroyed. The following provisions go into effect on April 6, 2023: Up to two (2) felonies of the third degree and a variety of felonies of the fourth and fifth degrees and misdemeanors can apply for sealing. Bail forfeiture can be sealed at the time of forfeiture.
The timeframe for requesting an expungement begins after your sentence including probation ends. For misdemeanor convictions and fourth or fifth-degree felony offenses, a one year waiting period is required. For a third-degree felony offense, a three-year waiting period is required.
It is a legal process provided under Section 2953 of the Ohio Revised Code that allows one to have any and all references to a prior criminal conviction cleared and their court file sealed. The result of this process is as if you were never convicted of the crime.
