Now in Maryland, there is one key guideline in terms of expungement and your eligibility. In Maryland, records in the Motor Vehicle Administration files, police files, and court files may be expunged. If you would like your record expunged it would be in your best interest to contact a knowledgeable criminal attorney.
There is no charge to expunge a case with a disposition of acquittal, not guilty, dismissal, PBJ, nolle prosequi, stet, or NCR. There is a $30 fee to file a petition for expungement of records with a guilty disposition (CC-DC-CR-072B). Filing fees are non-refundable.
If that happens, a hearing will be scheduled. If the court orders your record expunged, the process can take up to one year. Agencies such as the police department have 60 days from the date of the court order to remove your record.
Do peace orders or protective orders go on your record? Both of these orders appear on the Maryland Judiciary Case search which is a public database of the Maryland court system. In some cases, you may shield them from public view.
Whether an expungement will remove a record from the NCIC/FBI database will depend on whether it was a conviction or a non-conviction that was expunged. Convictions that are expunged will not appear on a MD criminal background check but may still appear on a National Crime Information Center (NCIC) record.
An Expungement is the removal of court and police records from public inspection. This does not include Motor Vehicle Administration records, which may have minor traffic violations, such as a speeding ticket. This process should take no more than 90 days unless there is an objection or an appeal.

If you received a PBJ, and you were later convicted of a new crime within 3 years of the PBJ, you cannot get the PBJ case expunged.
