How Long Does the Process of Expungement take in Ohio? An expungement takes about 6 weeks in Ohio. The fee for this application is $50 by Ohio law. The case is set on the docket in front of a judge who makes the final determination.
In most cases, sealed/expunged records will not appear on background checks. This means it may be easier for you to apply for a job, professional license, get housing, apply to college or apply for credit. But there are exceptions when sealed records may be accessed by some employers or agencies.
After BCII receive notification of the expunged record, their process to remove state records can take two to four months to complete.

That being said, some potential employers, like government agencies, can see expunged criminal records. In fact, prospective police officers and correctional officers must disclose having an expunged criminal record when applying to a position. The good news is expungement often acts as proof of rehabilitation.
Ohio criminal laws have been reformed by Senate Bill 288 which takes effect on April 4, 2023. This new law creates sweeping changes for the Sealing and Expunging of criminal records, including, conviction records, bail forfeitures, findings of not guilty, dismissed charges, and a No Bill issued by grand jury.
Complete the Waiting Period for Expungement For misdemeanor convictions and fourth or fifth-degree felony offenses, a one year waiting period is required. For a third-degree felony offense, a three-year waiting period is required.
