When your conviction is dismissed, it is not removed from your criminal record held by the California Department of Justice, but the record will show that your conviction was dismissed. Many public employers will likely be able to see your conviction, but will also see that it has been expunged.
What does that mean? Well, an expungement is a Court order directing all government agencies that have access to your record - the Clerk of Courts, the State Attorney, the police department, and the Florida Department of Law Enforcement - to destroy the record. Basically, it gets the charge off your record.
Information divulged on expunged records shall be revealed by a petitioner seeking employment within the judicial branch or with a law enforcement or corrections agency and such information shall continue to provide a disability as otherwise provided by law." N.J.S.A. 2C:52-27.
Who can access my criminal record after I get an expungement? A. Criminal records are “public records.” So anyone can access a criminal record even after a PC 1203.4 expungement — unless the record is sealed.
Section 943.0585, Florida Statutes, requires an individual, who prior to 1988 obtained an expungement order regarding a criminal history record, to disclose the existence and history of the criminal history record when so requested in connection with an application for the issuance or renewal of a teacher's certificate ...
The way that you can remove your criminal record from law enforcement databases is to be granted a Record Suspension, formerly known as a Pardon. However, the process to receive one is often lengthy, so many experts recommend starting the application process as soon as possible.
Because of the required process, it typically takes up to 9 months to have your record sealed or expunged. This is because the first step in the process that everyone must go through is obtaining a Certificate of Eligibility from the Florida Department of Law Enforcement.
You must also fill out a court form, called Order to Clear Record. Take it to your hearing. If the judge agrees to clear the arrest from your record, s/he will sign the Order. Then, the court clerk will send a certified copy of the Order to return or destroy all records about this arrest.
When a criminal history record is sealed or expunged, the public will not have access to it. Certain governmental or related entities, primarily those listed in Section 943.059(4)(a), F.S, have access to the sealed record information in its entirety.
The best way to find out if this has happened is to go to the Court where your case was at and ask to see the documents. If they do not have them the case was expunged and some private company has the records and provided them when the background check was done.
