Generally, you qualify for an expungement under Penal Code 1203.4 if you: committed a felony or misdemeanor and were not incarcerated in the California state prison, fulfilled the terms of your probation, and. were not convicted of one of the specific crimes that make you ineligible to receive a California expungement.
An eligible person must prepare and file a Petition for Expungement. The Petition for Expungement must be filed in the Superior Court in the county where the arrest or prosecution took place. A judge then decides whether the person should be granted an Expungement Order.
However, charges that did not result in convictions, regardless of the nature of the crime, can be expunged. Crimes or felonies which resulted in a conviction can generally be expunged ten years after you have completed your sentence, paid your fine, or completed parole or probation, whichever comes last.
Serious sex offenses, child ography, and certain vehicle offenses are not eligible for expungement. The full list of offenses not eligible for expungement if probation was sentenced includes: Misdemeanors under Vehicle Code Section 42002.1. Penal Code Section 286(c)

A felony will stay on your record forever in California unless you choose to take action and get the conviction removed. This is called the “expungement process” and generally requires the help of a legal representative to get underway. Rather than the federal courts, state courts handle the expungement process.
In most cases, you must wait five years after your sentence is served. All fines and fees must be paid. Sometimes, you can file for expungement after 4 years. You can expunge no more than one indictable conviction and up to three disorderly persons offenses or petty disorderly persons offenses.
If you are accused of another crime, the prosecution can use your past conviction as character evidence to demonstrate a history of criminal behavior. If you're convicted, the court can even use your expunged record for sentencing.
The Californian Penal Code allows for the expungement of the following infractions: Petty theft as per PC 484 & 488. Possession of marijuana. Disturbing the peace. Trespassing as per PC 602. Some types of fraud. Illegal purchase of alcohol by underage persons. Failure to appear.
