The expungement process is not a quick one. Once a petition for expungement is filed, it will usually take between 7-10 months for it to be returned. If there are any errors in the forms filed, the petition for expungement will be rejected and you must start the process all over again.
For some types of expungements, there is no filing fee. For example, if the charges were dismissed by the court without a deferment, or if you were found not guilty there is no filing fee. For other expungements, the courthouse will charge a filing fee of $175.00.
In general, you will likely need to pay $2.00 to get a certified copy of the charge you want expunged; $86.00 to file the petition; $12.00 to serve the petition on the Commonwealth's Attorney; $10.00 to obtain a fingerprint card; and, legal costs to your attorney to process the expungement.
The cost of an expungement proceeding can vary a little, based upon local charges. The fee for filing a proceeding is currently around $84 and the cost of serving the petition on the state is $12, for a total of $96.
If you cannot afford the fee, you may request that the court waive the filing fee. Form CC-DC-CR-072C. For cases where ALL charges have a disposition of acquittal, not guilty, dismissal, or nolle prosequi, entered on October 1, 2021 or later the court will expunge the case automatically after 3 years.
An Expungement is the removal of court and police records from public inspection. This does not include Motor Vehicle Administration records, which may have minor traffic violations, such as a speeding ticket. This process should take no more than 90 days unless there is an objection or an appeal.
Generally, you fill out a Petition for Expungement of Records and file it with the court that heard your case. If it has been less than three years from the time your case was concluded, you will also need to file a General Waiver and Release. A filing fee of $30 may apply. This filing fee is not refundable.
To file for annulment, the offender must pay a $100 fee and the court will look into their criminal record to make sure there are no other criminal charges and that no one will be endangered if the expungement is granted.
You can't expunge a violent misdemeanor, violent felony, and certain drug crime convictions. You might not be able to have a conviction sealed if you've been convicted of a separate felony offense, whether before or after the conviction you are seeking to expunge.
