You may be able to have your caution 'expunged' from your criminal record by applying to the police, via the ACRO Records Deletion Unit. You can do this yourself by setting out a well-argued and comprehensive reason as to why the police should consider 'expunging' your caution.
Information divulged on expunged records shall be revealed by a petitioner seeking employment within the judicial branch or with a law enforcement or corrections agency and such information shall continue to provide a disability as otherwise provided by law." N.J.S.A. 2C:52-27.
The current practice is for the police to store details of all recordable offences, and other specific offences, and for these to be held until the individual reaches 100 years old.
Nobody can see expunged records. Expungement completely removes these records, so they don't even exist. When a judge grants your request for criminal record expungement, all the agencies that have records on you must either destroy them or give them to you – so there's nothing for anyone to see.
The only way to get your conviction removed from police records is to appeal against the conviction through the courts. You will need to seek legal advice if this is something you wish to pursue.
If the person was 18 years of age or older at the time of the offense (i.e. legally considered to be an adult), then the conviction will be expunged from their record 11 years after the conviction date (not the offense date).
Can a police caution be removed? You may have been incorrectly advised to accept the caution. You may have been unfit to accept the caution. The police may not have followed their required process correctly – if this results in your caution being unfair, it can be grounds to have the caution removed.
The PNC is a computer system for England and Wales governed by section 27(4) of the Police and Criminal Evidence Act 1984. It is used to record convictions, cautions, reprimands and warnings for any offence punishable by imprisonment and any other offence that is specified within regulations.
Applicants 18+ at Time of Offence Therefore, any relevant offences will only be filtered from the criminal record check if they meet the following criteria: More than 11 years have passed since the conviction.
