When a criminal history record is sealed or expunged, the public will not have access to it. Certain governmental or related entities, primarily those listed in Section 943.059(4)(a), F.S, have access to the sealed record information in its entirety.
Expungement of an arrest record is handled by the Department of the Attorney General through the Hawaii Criminal Justice Data Center. You may also contact the Expungements section of the Department of the Attorney General at (808) 587-3348. Court records can be sealed and made confidential, through a court order.
The FCRA states that arrest records, civil judgments, civil lawsuits, and paid tax liens are not allowed to be reported on a consumer report or background investigation after seven years have passed. Many states have their own exceptions when it comes to the seven-year rule, and Texas is no different.
In Hawaii, an individual may expunge: The majority of adult felony and misdemeanor arrest records as well as criminal charges that did not result in a conviction; Convictions for first-time, drug-related offenses; and. Convictions for DUI while under the age of 21.
The Head of the Criminal Record Centre will inform the applicant in writing that his convictions and sentences have been expunged. Please note this process usually takes about 20 – 28 weeks.
