You can apply to have your criminal record expunged when: a period of 10 years has passed after the date of the conviction for that offence. you have not been convicted and sentenced to a period of imprisonment without the option of a fine during those 10 years.
Most misdemeanor convictions are eligible for expungement, but an individual can seek expungement for a maximum of two separate misdemeanor convictions. Serious Felony convictions such as armed robbery and aggravated stalking are not eligible for expungement.
Maryland law allows you to petition a judge and request a good cause expungement. When a client hires me for these, we typically file a motion to the Court and request a hearing. On many occasions, if the motion is well written and provides ample reasons why the case should be expunged early, a judge will grant it.
A lawyer will make sure your forms are filled out correctly and that you have met all other requirements for record sealing or expungement under the most recent state laws. The courts have 30 days to review an application for record sealing/expungement and decide whether to accept or deny it.
Unfortunately, there is no pure expungement in Arizona. Setting aside a conviction is Arizonas version of expungement, but it does not completely delete the conviction from your record like pure expungement does. Arizona law considers keeping convictions part of your record a matter of public protection.
A conviction for third degree and fourth degree crimes involving sale or distribution of drugs, or possession with intent to sell may be expunged if the court finds that expungement is in the public interest, considering the nature of the offense and the character and conduct of the petitioner since conviction.
Civil cases, including child support, liens, judgments, peace orders and protective orders CANNOT be expunged. may be denied by the court. When to File for Expungement: Certain misdemeanor convictions may be expunged after 10 years.
Most lawyers charge around $800 to set-aside (expunge) a criminal record in Arizona. Prices might be higher in Maricopa county as the courts in Maricopa are generally more difficult to deal with.
