A live scan will reveal all your criminal history. Live scan fingerprinting can even include your federal record. Typically, the summary of your criminal history record will include various things like arrests, charges, dispositions, convictions, dismissals, diversions, and others.
Non-convictions, including pardons, arrest records for arrests not resulting in conviction, and sealed or expunged records will not appear on a California criminal background check.
Utahs Clean Slate law was implemented on February 10th 2022 and the Utah Courts began the process of automatically expunging qualifying misdemeanor records.
Federal agencies, including USCIS, have the ability to see complete criminal histories of all applicants, including any sealed or expunged records. This information will be available to USCIS officers when they conduct a background check on the applicant.
Sealed records may also be visible on FBI background checks, primarily through Live Scan fingerprinting. Sealing is a legal process intended to restrict access to certain criminal records, but it doesnt always guarantee complete confidentiality.
A: In California, a Live Scan background check typically includes criminal history information that can go back indefinitely. However, for employment purposes, there are restrictions under California law regarding how far back an employer can consider criminal history.
A person who has any pending criminal charges is not eligible for expungement. Minor traffic offenses cannot be expunged (except if released without charges). The following court supervision records also cant be expunged: reckless driving (age 25 or older), DUIs, and sexual offenses against a minor.
