Under a new law signed by Governor Bill Haslam on May 5, 2017, certain individuals can now get two convictions expunged in Tennessee.
Additional fees and procedures must also be taken if you are attempting to expunge a Tennessee criminal conviction. Once an Order is filed to have the records relating to your charge expunged, it may take as long as 2 to 6 months to complete your expungement, depending on the circumstances of your case.
Expungements Under T.C.A 40-32-101(k) On July 1, 2017, a new law went into effect that allows people convicted of certain offenses in Tennessee to have two (2) offenses expunged from their records, pursuant to T.C.A. 40-32-101(k).
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
A person must pay $100.00 to the court clerk each time he or she files a petition for expungement of a Tennessee conviction. In some circumstances, additional court costs may be required. A person may file a Tennessee expungement petition 5 years after the completion of the sentence for the Tennessee conviction.
Under Tennessee law, DUI convictions cannot ever be expunged, but will permanently remain a part of the public record.
