If you have a gross misdemeanor on your record and have not been convicted of a new crime for at least three years after completion of your sentence, you are most likely eligible for an gross misdemeanor expungement under the new Minnesota expungement law.
Under West Virginia Code 61-11-26, a person may petition the circuit court in the county where the conviction or convictions occurred. A person is eligible for expungement one (1) year after the conviction and completion of any sentence of incarceration and any period of supervision.
If the court grants the expungement, this charge will not appear when someone runs a background check on you. Conversely, if the charge is dismissed and you dont get an expungement, the charge will appear on your record but it will show that the charge was dismissed.
Records cannot be expunged, even with a pardon, for first degree murder, treason, kidnapping, or sexual offenses. W. Va. Code 5-1-16A(e).
Offenses that could not be expunged or set-aside included offenses like murder, criminal sexual conduct or any traffic offense.
Criminal Charges: No filing fee is required. Criminal Convictions: There is a $200 filing fee, with potential waivers, and a $100 fee to the West Virginia State Police if the expungement is approved.
Summary convictions : Summary (S) convictions can be expunged as long as you have been arrest-free for five years following the conviction and paid all fines and costs. Keep in mind that Summary (S) convictions are eligible for expungement sooner than they are eligible for sealing.
The Court within sixty (60) days of the filing of the Petition may grant the Petition without a hearing, set the matter for a hearing, or deny the Petition. A person granted expungement must pay a fee of $100.00 to the records division of the West Virginia State Police for the cost of processing the expungement.
