How Long Does It Take To Expunge or Seal a Case? Generally, the entire expungement and sealing process takes three to six months in Illinois.
Public Law 14-2022, which went into effect July 1st, amends IC 35-38-9-1 to provide for automatic expungement of all records related to the criminal charges 60 days after dismissal or acquittal. Automatic expungement applies to persons charged with an offense after June 30, 2022.

A person who has any pending criminal charges is not eligible for expungement. Minor traffic offenses cannot be expunged (except if released without charges). The following court supervision records also cant be expunged: reckless driving (age 25 or older), DUIs, and sexual offenses against a minor.
The filing fee for expungement/sealing is $215.00, which covers the cost of filing the petition, copy fees, mailing and postage fees for the required notices, and fees to the Illinois State Police.
A fee waiver allows you to file for free, or at a reduced cost. You must send a copy of your Motion and Notice of Motion forms to the States Attorney, Arresting Agencies, Chief Legal Officer of the Unit of Local Government, and Illinois State Police. Learn more about filing a motion.
