Once youamp;#39;ve received an expungement you can legally say youamp;#39;ve never been charged with that crime. My name is Anastasia. Iamp;#39;m a criminal defense attorney at Dummit Fradin and I handle expungements. Most people get an expungement so that schools, employers, and even landlords never find out about your past. While an expungement is great, there are certain limitations on it. For example, district attorneys and police academies can see these expunged records. Once a charge is expunged, it comes out of those public terminals fairly quickly. But it can take months up to at least six, eight, even a year before those charges are completely removed from the public and private domains. Even after the expungement has been filed, it may take months for private agencies to update their own records to reflect this expungement. Most drug and property felony convictions can be sealed after 10 years or longer without a felony or misdemeanor conviction. The waiting period for misdemeanor sealing is reduced to 7 years. Makes clear that sealed and expunged records cannot be used to deny opportunities in employment, housing, or education.
Expungement removes arrest or criminal conviction data from your criminal record. You can start the process by filling out Form SP 4-170 Request for Access and Review.
Pennsylvania has expungement laws that help people who received a summary offense, Accelerated Rehabilitative Disposition (ARD) or had an arrest that did not lead to a conviction. Expungement usually takes about 4 to 6 months. Attorneys typically charge between $700 to to $1000 to expunge your record.
On December 14, 2023, Clean Slate Expansion (Act 36) became law in Pennsylvania. Expanding on the original Clean Slate, Pennsylvanians will now be able to seal felonies for the first time, among other important changes to the sealing law. We believe that hundreds of thousands of people will benefit from the new law.
Expungement completely erases and destroys a record. Sealing (limited access) hides the record so it does not appear on background checks for employment, housing and education purposes.
What kinds of charges are eligible for expungement in PA? All criminal charges that did not result in a conviction are eligible for expungement in Pennsylvania.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
