There are certain rights that can only be restored through the pardon process (those rights will NOT be restored through the expungement process), such as your right to own and possess a firearm. If you have questions regarding the restoration of certain rights, you should speak with a lawyer.
With the exception of a first offense failure to stop for a blue light, traffic convictions CANNOT be expunged. Fish and wildlife convictions CANNOT be expunged. Convictions for felonies or heinous crimes CANNOT be expunged.
Traffic offenses, motor vehicle offenses, and wildlife and game offenses cannot be expunged. First Offense Conviction for Failure to Stop When Signaled by a Law Enforcement Vehicle. This conviction is eligible when: It is a first offense.
First offense simple possession of any drug can now be expunged after three years; First offense possession of prescription drugs can be expunged after three years; and. First offense possession with intent to distribute (PWID) and drug can be expunged, however not until 20 years after completion of the sentence.
There are fees associated with an expungement, except when charges are dismissed or nol prossed (not prosecuted), or when a person is found not guilty. In those cases, the expungement is FREE, unless charges are dismissed in plea negotiations.
Otherwise, there are several administrative costs for expungement in South Carolina including a non-refundable fee of $250 to the solicitors office, a non-refundable fee of $25 to SLED, and a $35 fee to the county clerk of court.
Pursuant to the South Carolina Code of Laws, a criminal record may only be expunged through an application to the court, which must be signed by a judge. An individual should contact the solicitors office in the area where the charge originated to seek assistance and obtain an application, which does require a fee.
How long does the expungement process take? The process may take up to six (6) months from the date the Expungement Office receives the completed Expungement Application. You will NOT receive a confirmation of receipt of your Expungement Application.
