While an expungement is great, there are certain limitations on it. For example, district attorneys and police academies can see these expunged records. Once a charge is expunged, it comes out of those public terminals fairly quickly. But it can take months up to at least six, eight, even a year before those charges are completely removed from the public and private domains. Even after the expungement has been filed, it may take months for private agencies to update their own records to reflect this expungement. 77-40a-101(14)(a) Most traffic offenses can be expunged without limit as long as time periods have been met and have no pending cases or fines owed. Traffic charges are not included in determining if a person is eligible for future certificates of eligibility and expungement.
What fees do I pay for an expungement? You must pay a $250.00 administrative fee to the Solicitors office, a $25.00 fee to the South Carolina Law Enforcement Division (SLED), and $35.00 filing fee to the Clerk of Court. You pay the fees with separate money orders when you apply to your Solicitors office.
About Utahs Clean Slate Law This law went into effect on February 10, 2022, but the Administrative Office of the Courts expects that it may take until early 2023 to identify and clear all clean slate eligible records.
These include capital felonies, certain violent felonies, felony automobile homicide, registrable sex offenses, and registrable child abuse offenses. If you have one of these types of offenses on your record, and would like to try to get it removed, you will need to go through the Utah Pardon process.
