To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
In most cases, sealed/expunged records will not appear on background checks. This means it may be easier for you to apply for a job, professional license, get housing, apply to college or apply for credit. But there are exceptions when sealed records may be accessed by some employers or agencies.
Rape, sexual batter, corrupting a minor, gross sexual imposition, sexual imposition, obscenity involving a minor, ography involving a minor, illegal use of a minor in ography, and felonious sexual penetration are all convictions that cannot be expunged.
In most cases, you can expect to wait 30-90 days to schedule the hearing date after you file this petition. The entire process can take up to six months to complete. Once the court grants your expungement, however, it may take agencies up to 6 months to destroy records complete.
Sealing an Ohio Record is not just limited to sealing convictions. Criminal records of a dismissed charge, no-bill charge, acquittal of charge, bail forfeitures, and juvenile charges can be sealed in Ohio.
You are most likely to be entitled to expunge your records if you meet the following criteria: You have been convicted of a felony or misdemeanor. You are not currently facing any criminal charges. You are not currently serving a sentence for a criminal offense. You did not serve time in a California state prison.
The Second Chance Act of 2007 aims to reduce recidivism, rebuild ties between defendants/persons under supervision and their families, support evidence-based practices, protect the public, and assist in establishing a self-sustaining life.
Expungement means that the record is completely destroyed. The following provisions go into effect on April 6, 2023: Up to two (2) felonies of the third degree and a variety of felonies of the fourth and fifth degrees and misdemeanors can apply for sealing. Bail forfeiture can be sealed at the time of forfeiture.
