A judge will only show the expunged record to law enforcement if the defendant is under investigation in a new criminal case. The only times when a judge will make the expunged record visible on a pre-employment background check is if the defendant is applying for a position in an education or law enforcement career.
In general, expunged criminal records do not show up on background checks. Usually, if people expunge their records, they do not have to disclose them when asked. As a result, this helps people find a job more easily.
An FBI background check typically shows the following information: Criminal charges, convictions, and incarceration. Bankruptcies. Outstanding warrants. Arrests that did not result in convictions (these remain on record for seven years) Addresses and phone numbers used on tax forms.
Expungement completely erases and destroys a record. Sealing (limited access) hides the record so it does not appear on background checks for employment, housing and education purposes.
If you were convicted of a misdemeanor or a felony, and not sentenced to state prison, and you have completed the terms of your sentence, you may file a petition pursuant to Penal Code Section 1203.4 or 1203.4a. Many criminal offenses can be dismissed from your record.
Expunged records can, in some cases, appear on FBI background checks, especially those conducted by law enforcement or certain government entities.. While expungement is meant to remove or restrict access to criminal records, the effectiveness of the process varies by jurisdiction.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
There is a new law in California that went into effect in 2023 called the California Clean Slate Act (SB 731). Under the Clean Slate Act, authorities will automatically expunge or dismiss certain arrests and criminal convictions.
