To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
New Virginia Expungement Law Takes Effect in 2025. The Virginia General Assembly passed a new expungement law in 2021. The law, which takes effect in 2025, makes expungement automatic in some cases and expands expungement eligibility to some criminal convictions.
Virginia law does not currently allow for expungement of convictions or deferred dispositions; whereas, a sizeable number of states authorize such actions: 41 states allow misdemeanor convictions to be expunged or sealed; and, 36 states allow felony convictions to be expunged or sealed.
The federal Fair Credit Reporting Act (FCRA) also imposes limits on some background checks for employers that choose to work with a consumer reporting agency (CRA). The FCRA allows criminal convictions to be reported indefinitely in most searches, but non-conviction criminal information is limited to just seven years.
Judges, law enforcement, and some Commonwealth employers may have access to expunged records. Expungement in Virginia is very limited because it requires innocence. That means only not guilty or nolle prosequi dispositions, and dismissals, are eligible for expungement.
Under Virginias current expungement law, even with the help of a lawyer, expunging a criminal record often takes at least nine months, and sometimes much longer. Because the new law includes automatic sealing, some records will be sealed on a monthly basis, as soon as they become eligible.
Can you remove an Article 15 from your record? Submit a formal application. Provide compelling evidence. Clearly illustrate why the original decision might have been unjust or improperly recorded.
If the court grants the expungement, this charge will not appear when someone runs a background check on you. Conversely, if the charge is dismissed and you dont get an expungement, the charge will appear on your record but it will show that the charge was dismissed.
