Oklahomas Clean Slate Bill creates a system that will automatically expunge certain crimes. Expungement means the record of the crime will be sealed from public view. With a traditional expungement, you have to complete an application and go through a hearing process.
A Section 18 expungement allows a person to expunge their entire arrest record. A Section 991(c) expungement allows a person who received a deferred sentence to expunge their plea, and have the disposition of their case updated to show the case has been dismissed.
For a Class B Felony: seven years from the date of your most recent conviction or release from prison. For a Class C Felony: five years from the date of your most recent conviction or release from prison. In these cases, the answer to How long do felonies stay on your record in Oklahoma? is forever. If you have a violent felony on your record, you can get a pardon, which restores your gun rights and voting rights but doesnt wipe your record.
More than two felony convictions requires you to also get a Governors pardon. Oklahoma lengthens the time expungement takes for those who have two or more felony convictions. Once again violent felonies or require sex offender registration can not be expunged.
In general, you are eligible to have a record expunged if no charges were filed, the charges were dismissed, the charges were deferred and dismissed, you were found not guilty, or you were pardoned. You cannot expunge a record if you have charges pending for either a misdemeanor or a felony.
How much does an expungement cost? Expunging your court record is free. Expunging your arrest record requires paying a $150 processing fee. It may also require fees be paid to local law enforcement agencies expunging their records.
Oklahoma law regarding the sealing and expungement process from criminal records has recently changed. The new law was signed on the 2nd of May, 2022. This new law makes the expungement process possible for all misdemeanors, and a number of non-conviction felony criminal records.
