To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Individuals who were acquitted of charges, have cases dismissed with prejudice, or have conviction records that meet the definition of clean slate eligible under the statute will benefit from automatic expungement under Utahs Clean Slate law.
77-40a-101(14)(a) Most traffic offenses can be expunged without limit as long as time periods have been met and have no pending cases or fines owed. Traffic charges are not included in determining if a person is eligible for future certificates of eligibility and expungement.
These include capital felonies, certain violent felonies, felony automobile homicide, registrable sex offenses, and registrable child abuse offenses. If you have one of these types of offenses on your record, and would like to try to get it removed, you will need to go through the Utah Pardon process.

Other charges are deemed so severe, they cannot even be sealed, such as felony domestic violence, child abuse, or sexual misconduct. However, you may be able to get a felony arrest expunged if the case was dismissed. Other examples of felony cases that you cannot expunge are: First-degree felony for aggravated battery.
Utahs Clean Slate law was implemented on February 10th 2022 and the Utah Courts began the process of automatically expunging qualifying misdemeanor records.
