You may be immediately statutorily eligible for an expungement if the final disposition of your case was that charges were: dropped, dismissed, acquitted (not guilty) or arrested without charging. This is true regardless of whether you were charged with a felony or a misdemeanor.
What fees do I pay for an expungement? You must pay a $250.00 administrative fee to the Solicitors office, a $25.00 fee to the South Carolina Law Enforcement Division (SLED), and $35.00 filing fee to the Clerk of Court. You pay the fees with separate money orders when you apply to your Solicitors office.
Expunging Your Record ($375.00) Preparing petitions, orders, notices, and any corroborating documents. Making court appearances and arguing your case before the judge and filing motions to reconsider, if necessary. The attorneys fee for expunging your record is $375.00.
Required Costs: Application for Certificate of Eligibility: $65. Fingerprinting from Local Law Enforcement: ~$10. BCI Certificate Fee: $65. Court Filing Fee: $150.
A person who has any pending criminal charges is not eligible for expungement. Minor traffic offenses cannot be expunged (except if released without charges). The following court supervision records also cant be expunged: reckless driving (age 25 or older), DUIs, and sexual offenses against a minor.
A sealed record is unavailable without a court order. Therefore, your record will not appear on a background check of government records if you receive an expungement or a sealing.
Utahs Clean Slate law was implemented on February 10th 2022 and the Utah Courts began the process of automatically expunging qualifying misdemeanor records.
Violent Crimes encompass offenses such as murder, attempted murder, and aggravated battery. These crimes involve docHub harm or threat of harm to individuals, making them ineligible for expungement. Convictions for a felony or misdemeanor offense also cannot be expunged.
