Sealing and Expunging Criminal Records Step 1: Obtaining and Completing the Application. Step 2: Submit Application to the State Attorneys Office. Step 3: Submit completed application to FDLE. Step 4: Complete and File a Petition and Affidavit to Expunge or Seal Step 5: Filing the Petition.
Florida law permits the sealing or expunging of only one criminal history in a lifetime.
The filing fee for an expungement petition is $75. Other costs associated with this method of filing will include photocopying documents, mailing the documents using certified mail, and the purchase of stamps and envelopes. The total cost would be about $200.
A judge will only show the expunged record to law enforcement if the defendant is under investigation in a new criminal case. The only times when a judge will make the expunged record visible on a pre-employment background check is if the defendant is applying for a position in an education or law enforcement career.
(1) ELIGIBILITY. A person is eligible to petition a court to expunge a criminal history record if: (a) An indictment, information, or other charging document was not filed or issued in the case giving rise to the criminal history record.
In the state of Florida, you typically can only have your case sealed and expunged once in a lifetime. Under Section 943.059, Section 943.0585, or previous versions of those statutes, in Florida. With respect to the relief offered by these statutes, a person may only seal or expunge one arrest record in one proceeding.
Under N.J.S.A. 2C:52-7, a person who has committed only one (or no) indictable offense during the course of his entire life will be eligible for an expungement. In other words, someone who was convicted of two or more indictable offenses cannot seek an expungement except under very specific conditions.
