In general, you are eligible to have a record expunged if no charges were filed, the charges were dismissed, the charges were deferred and dismissed, you were found not guilty, or you were pardoned. You cannot expunge a record if you have charges pending for either a misdemeanor or a felony.
It usually costs about $1,500- $2,000 to expunge your record. There is a $150 fee to file the petition with OSBI, and court fees will cost you about $175. Plus, you might need to pay other fees if your case requires multiple agencies, districts, and sign-offs.
Oklahomas Clean Slate Bill creates a system that will automatically expunge certain crimes. Expungement means the record of the crime will be sealed from public view. With a traditional expungement, you have to complete an application and go through a hearing process.
For deferred cases where you plead guilty, but your sentence was deferred: The judge can grant the expungement under Section 991C at no cost to you. You can request this at your deferred review. you can ask later by calling the court for the local procedure.
How much does an expungement cost? Expunging your court record is free. Expunging your arrest record requires paying a $150 processing fee. It may also require fees be paid to local law enforcement agencies expunging their records.
A Section 18 expungement allows a person to expunge their entire arrest record. A Section 991(c) expungement allows a person who received a deferred sentence to expunge their plea, and have the disposition of their case updated to show the case has been dismissed.
